Our discussion of traditional nexus as well as nexus expansion legislation at the federal and state level will focus on this question: how can a seller of digital goods and services determine where it has a filing obligation for sales and use tax?
Taxability of digital goods and services
We will explore the considerations as to how states characterize digital goods and services for sales and use tax purposes; if the state would consider the offering taxable, how would it be sourced? Can it be taxed in multiple states?
Common audit issues
We will also discuss the most common issues encountered in a sales tax audit of an e-commerce business, with a focus on the Mid-Atlantic states.
Some pointers and recommendations about ways to mitigate sales and use tax risks associated with digital goods and service offerings will be shared.
